Terms and Conditions

The Key Criteria for winning videos are:
1) imagination (2) means of promotion (number of hits) (3) exploration of the theme of Europe 2020. 75% of the marks for the movie will be given over to creativity and imagination, and 25% for building an audience.

  1. To enter Darklight/EU's 'Europe 2020' filmmaking competition (the “Competition”) you must create a short film of no more than one (1) minute in length (the “Video”) exploring the concept of 'Europe 2020' and upload your Video via a recognised video hosting site e.g. (“You Tube”); (“Vimeo”). If you are not a registered user of a video uploading site, you must register an account with the web uploading site by entering your details online. The video hosting site's terms and conditions will apply. There is no limit to the number of Videos you may submit and no restriction on any assistance you may receive.
  2. You may not use any copyrighted material in your Video, including without limitation soundtracks and footage belonging to third parties used without their consent (eg. you should not use a commercial sound recording). The Promoter reserves the right to screen each Video before it is posted on the video hosting site. If a submitted Video is deemed by the Promoter to be in breach of copyright or potentially libelous, offensive or otherwise unlawful in any way or in breach of the video hosting site's guidelines and/or terms of use, we reserve the rights to remove it and/or to refuse to award a prize to any person who has submitted any such Video.
  3. No purchase is necessary to enter the Competition and there is no charge to access the website www.darklight.ie/Europe2020 website (the “Website”).
  4. All entries for judges' competition must be received by 12:00pm on 14 October 2011.
  5. You must be over 12 years of age at the closing date. When contacted, you may be required to provide proof of age. If you are under 18 years of age, you must obtain consent from a parent or guardian (who must be over 18 years of age) in order to participate. We reserve the right to refuse to award a prize to any person under 18 who has not obtained any such consent and/or to remove any entries from the video hosting site (You Tube, Vimeo, Google Video etc).
  6. Employees, families or agents of the Promoter and/or any of its associated companies are not eligible to enter the Competition. In any event, the Promoter reserves the right to refuse any entry which it considers in its sole discretion to be ineligible in accordance with these Terms and Conditions.
  7. By entering the Competition, you hereby warrant that all information submitted by you is true, current, complete and not misleading.
  8. By submitting your Video, you agree to allow the Promoter to contact you via your video hosting account with regards to the Competition only. All entries must be made in accordance with these Rules. The winners may be required to participate in publicity surrounding this promotion. It is a condition of the Competition entry that Darklight/EU may use submitted Videos in any or all media in perpetuity.
  9. The winner of the judges' first prize, and 2 runners up, will be selected by a panel of film professionals including a judge independent of this Competition (“Panel”). The winning entries will be judged on the following criteria: (1) imagination (2) means of promotion (number of hits) (3) exploration of the theme of the 'Europe 2020' and will be chosen on 19 October 2011. All the winners will then be notified by email or their video hosting account within 3 days of being selected. If the Promoter is unable to contact the winners within 3 days or if the winners prove to be ineligible, an alternative winner will be chosen in respect of the unclaimed prize. The Promoter's decision is final and no correspondence will be entered into. One prize per entry only.
  10. The winner of the first prize, and 2 runners up, will be awarded to the videos with the highest rating and the highest number of views by the 14 October 2011. All the winners will then be notified by email or their You Tube account within 3 days of being selected. If the Promoter is unable to contact the winners within 3 days or if the winners prove to be ineligible, an alternative winner will be chosen in respect of the unclaimed prize. The Promoter's decision is final and no correspondence will be entered into. One prize per entry only.
  11. The winner will receive a 60d camera, or similar prize of equal value.
  12. The Promoter accepts no responsibility or liability for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft, destruction, alteration of, or unauthorised access to entries, or entries lost, incomplete or delayed whether or not arising during operation or transmission as a result of server functions, virus, bugs or other causes outside its control. All lost, damaged or incomplete entries will be deemed invalid. Proof of entry shall not be proof of delivery or receipt.
  13. By entering this Competition, you give us all necessary consents in relation to your personal data (e.g. your name, email address, photograph) in order for us to operate the Competition. Any personal data relating to entrants will be used solely in accordance with current Irish data protection legislation and will not be disclosed to a third party without your consent.
  14. By entering the Competition, all entrants are deemed to accept these Terms and Conditions. The terms and conditions of any third party supplier (including a supplier of any prize) may apply and must be accepted and complied with by the winner.
  15. The Promoter reserves the right to amend these Terms and Conditions or to modify or cancel the Competition without notice in the event of a catastrophe, war, civil or military disturbance, act of God or any actual or anticipated breach of any applicable law or regulation or any other event outside its control.
  16. On submitting a Video, each entrant irrevocably and exclusively grants to the Promoter a irrevocable, perpetual license to make available, adapt (for broadcast and promotion purposes only), copy and distribute the Video in all media worldwide and to sublicense such rights to third parties.
  17. Other than for death or personal injury arising from negligence of the Promoter, so far as is permitted by law, the Promoter hereby excludes all liability for any loss, liabilities, damage, cost and expense, whether direct or indirect, howsoever caused incurred by you in connection with the Competition or any aspect of a Prize. The Promoter does not accept responsibility for any damage (whether material or non-material) caused to entrants, to their computer equipment or to data which is stored on them, or to their personal, professional or commercial activities. The Promoter will not be liable if a prize cannot be taken by a winner for any reason.
  18. These Terms and Conditions will be exclusively governed by and construed and performed in accordance with the laws of Ireland. You irrevocably submit to the exclusive jurisdiction of the courts of Ireland.
  19. The promoter of the Competition is the European Commission, 18 Dawson St., Dublin 2 and Darklight, The Factory, 35a Barrow Street, Grand Canal Dock, Dublin 4
